土地承包經(jīng)營權(quán)流轉(zhuǎn)糾紛解決的法律思考

摘  要

土地承包經(jīng)營權(quán)流轉(zhuǎn)糾紛類型多樣，流轉(zhuǎn)糾紛數(shù)量大、隱患大、調(diào)處難度大，流轉(zhuǎn)糾紛的形成既有政策和立法的原因，也有司法、行政管理及流轉(zhuǎn)行為自身欠缺等方面的原因�，F(xiàn)行解決土地承包經(jīng)營權(quán)流轉(zhuǎn)糾紛的訴訟救濟方式和非訴訟救濟方式均存在諸多問題。為預(yù)防和處理農(nóng)村土地承包經(jīng)營權(quán)流轉(zhuǎn)糾紛，有必要從立法、行政、村民自治以及司法各個層面思考應(yīng)對策略。

Abstract

Land contracted management rights transfering are various types of disputes, and transfering disputes have large quantities, hidden dangers, and handling difficulty ect .characters. Circulation disputes both the formation of policy and legislative factors, but also justice, administration and their own lack of transfering and other reasons. Solve the existing land contract management rights transfering disputes and litigation relief means non-litigation relief means there are many problems. For preventing and dealing the rural land contracting and management rights transfering disputes, it is should to from legislative, administrative, villager autonomy and justice at all levels of thinking strategies.
